Collections legal fees need to make sense or there is no point in pursuing outstanding account receivables. While some of our clients willingly pay legal fees that far exceed the amount owed to them on principal, we discourage this. Hourly billing is how most litigation service fees are offered. The unpredictable nature of conflict does not allow us to have a set flat fee. The Nature of Legal Debt Collections
Collecting money that is owed to your business can be difficult for a business owner. When we act for businesses for collections, differing methods of collections produce differing results. If someone legally owes you money and there is no valid defense, then you should win if the matter goes to trial. Often times, in law, a lot of grey areas exist. Few clients face “a guaranteed win”. In addition, the cost of a full trial often exceeds the debt owed. Debtors know this but they also know that the cost of defending a trail can be equally as high. Further, if they lose, debtors often face court costs (or, sometimes, solicitor client costs) awarded against them. Accordingly, as a percentage of all debt owed, very few matters actually go to trial.
Often times a strongly worded letter from a lawyer demonstrates a creditors determination to collect. In these cases, a demand letter is all that is required to collect the outstanding debt. Lawyers acting for collections of debt due so for routine claims on outstanding accounts receivables. These are not applicable to other types of damages or claims. Flat Rate Legal Fees for Debt Collections
In an effort to meet client needs we have set out a flat rate collections legal fees menu. We offer each of the below on an individual basis. Further, we due to the nature of this limited retainer, we set out the specific work offered below.
Demand Letters
Demand letters are the initial letter sent by a lawyer demanding payment. In many instances, we need no further steps to collect funds for you. We will send you an intake email with the key
information that we need. The below fee is the cost for drafting a demand letter, sending it to the debtor by fax or regular mail (you may decide), one phone call with the debtor to negotiate a settlement amount that you have predetermined in the intake email, accepting payment and having payment here for for pickup.Flat rate demand letter collections legal fee are (based on the number of letters):
- 2 -5 demand letters $449 each
- 6-10 demand letters $399 each
- 11-20 demand letters $349 each
- 20 plus demand letters $299 each
We allot volume discounts based on number of demand letters that you decide to retain Kahane Law Office for at one time. For ongoing, regular collections matters, please call or email for reduced fee volume options. Please note that we do not do flat rate demand letters on contingency. We do offer a partial contingency demand letter. On debts that exceed $2000 we offer a $200 reduction per letter in exchange for 15% of the recovered debt.
Builders’ Liens
We will file builders’ liens as a part of collections. Our policy is that we offer collections legal fees for builders’ liens on a flat rate basis. We will send you an intake email with the key information that we need. The below fee is the cost for drafting the lien, registration costs (including courier to land titles), sending it to the debtor by fax or regular mail (you may decide), one phone call with the debtor to negotiate a settlement amount that you have predetermined in the intake email, accepting payment and having payment here for for pickup.
Flat rate builder’s lien collections legal fees are (based on the number of letters):
- 2 -5 demand letters $499 each
- 6-10 demand letters $449 each
- 11-20 demand letters $399 each
- 20 plus demand letters $349 each
We allot volume discounts based on number of builders’ liens that you retain Kahane Law Office for at a single time. For ongoing, regular collections matters, please call or email for reduced fee volume options. Please note that we do not do flat rate builders’ liens on contingency. We do offer a partial contingency builder’s liens. On debts that exceed $2000 we offer a $200 reduction per lien in exchange for 15% of the recovered debt.
Civil Claims (Provincial Court, Small Claims Court)
We will draft a civil claim for small claims court as a part of your debt collections strategy. We offer drafting civil claims legal fees for claims under $25,000 on a flat rate basis. These are based on multiple civil claims on the same matter. We will send you an intake email with the key information that we need. The below fee is the cost for drafting the civil claim. We will not file or serve the claim for this fee. You may do so or we will send a un-filed civil claim to the debtor with a demand letter for an additional $125 per claim.
For this fee we will drafting the letter to the defendant, send it to the debtor by fax or regular mail (you may decide), one phone call with the debtor to negotiate a settlement amount that you have predetermined in the intake email, accepting payment and having payment here for for pickup.
Flat rate civil claim collections legal fees are (based on the number of letters):
- 2 -5 demand letters $599 each
- 6-10 demand letters $549 each
- 11-20 demand letters $499 each
- 20 plus demand letters $449 each

End of Collections Retainer
Limited retainers allow you to have our firm attempt debt collection with debt collections legal fees that are manageable, predictable and reasonable. They allow for set debt collections legal fees. You are not required to bring in a further retainer but we can take a matter to small claims court or the Court of Queen’s Bench. The following are examples of legal work not included in the collections legal fees:
- negotiations past the allotted phone call;
- filing civil claims;
- serving civil claims; and
- releases (mutual or other)
Matter that require the above are treated as regular litigation files and will require a retainer and hourly rate will apply.
