How To Hire Us For Your Real Estate Transaction

Kahane Law Office has an experienced team of real estate paralegals and lawyers to help navigate your real estate transaction. Our process is outlined below so it is clear how we will work with you during the purchase, sale or refinance of your property. When you’ve decided to retain Kahane Law Office for your real estate transaction, simply follow the steps below.

How Our Process Works

  1. Email us a copy of your real estate documents (Real estate contract). If you’re working with a realtor, they will need to know where to send your documents*. For the fastest efficient service email [email protected] which is our conveyancing department. *Please provide us with any important details that pertain to your deal. For example, you will be out of the country for signing or you live out of the province. We will ensure to help navigate your unique situation.
  2. Once our conveyancing department receives your documents, they will begin the process of inputting your information into our system. They will assign a lawyer and paralegal that will work with you.
  3. You’ll receive a “welcome” email from our conveyancing department that will indicate who your lawyer and paralegal is. Your assigned team of professionals will help you with any questions along the way. They are here to help you. Don’t hesitate to contact them!
  4. Your paralegal will correspond with you and contact you about a week prior to the closing date to schedule a signing appointment with your lawyer.
  5. You will have your signing appointment to finalize your transaction with your lawyer. They will go over in detail all aspects of your transaction either in person or over zoom (if you are unable to meet in person).

What Flat Rate Real Estate Legal Fees Include

Flat rate legal fee packages mean that we include all regular disbursements, when signed in a single appointment in our Calgary or Edmonton offices. This means there is no additional charge for file administration fees, document fees, courier charges within Calgary or Edmonton, photocopy charges, fax charges, land title fees to register one title and one mortgage, two hours of purchase/sale related issue resolution and two separate payouts, if required, in residential real estate files. Out of town signings may be subject to an additional fee for a signing agent in the area that they are signing and delivery charges to return the documents to our office. Zoom meetings are an additional fee.

The Following Are Examples Of Items Not Included In Real Estate Legal Fees

Title insurance, additional mortgages, estoppel certificates, encroachments agreements, relaxation permits, encumbrance downloading & reviews, additional titles (parking / storage legal units) for condos, insurance certificates and Real Property Reports.

Mobile Home Flat Rate Fees for Purchases and Sales

We offer the following flat rates for mobile homes. Legal fees for the sale of a mobile home are $850 if there is a payout of a debt associated with the mobile home or $750 if there is not. Legal fees for a purchase of a mobile home with a chattel mortgage is $920 and $820 if the purchaser is not getting financing. These fees are valid for mobile homes without titled land included.

How Real Estate Legal Fees Are Paid

You pay real estate legal fees differently depending on the type of transaction. These include:

Real Estate Purchase Legal Fees

For real estate purchases, the amount that you bring in to your signing appointment include the legal fees. The certified cheque includes the rest of your down payment, adjustments for things like condo fees, property taxes and homeowner association fees and our legal fees.

Real Estate Sale Legal Fees

When you sell your home, you will not need to bring in money in advance (unless there is not enough equity in the property). When we receive the sale funds from the buyers’ lawyer, we will pay out any mortgage or line of credit, any outstanding real estate commissions and our legal fees.

Refinance (Re-Mortgage) Legal Fees

For a mortgage refinance, we draw down the new mortgage funds from the lender. We then pay out any existing mortgage and debts that the lender requires for payment and our legal fees. Unless there is not enough new equity, you will not need to bring in separate payment.

Transfer of Land Legal Fees

If you are just transferring title to your property, we will require our fees prior to the transfer. You may pay when you come in to sign the transfer documents. If the transfer is a part of a refinance, then the fees, equity permitting, may come from the new mortgage proceeds. Find our fees for transfers here.
